EB1/EB2 - Is it an option?
USCIS says if approved, the applicant can apply for adjustment if in legal status. Would holding DACA work for those with masters/phd (further: would it be different for those with <180 days overstay after 18 vs >180)?

You’d have to leave country for consulate processing if you have accrued illegal presence.

I believe 245i is required prior to anything.

I'm doing a similar process for work (EB2). First we would need to get the PERM labor approved. Then we would need a 601 waiver approved showing hardship to a USC/LPR family member. Finally, consulate processing in Ciudad Juarez.
I have accrued illegal presence though. If you haven't or if you are covered by 245i you might be able to AOS in the US. If you're asking this, I'm assuming your company is willing to sponsor you. Just talk to their lawyer. |
