I'm not 100% sure but if that person came into the US on december 2000 or before and be able to prove he/she did, he/she is protected under 245(i) amendment. Take a look:

Petition was filed from my aunt for my dad(directly related brother) back in 1997 and I was 14 back then, and it took slightly over 10 years for USCIS to notify us to submit required paper works....
