my theory on this, probably not the first to think this but:

Obama made some crucial calculations in providing deferred action. Normally, if I recall right, the Dream Act would have required them...

It needed a simple minority because it was being passed onto the senate for a vote, meaning that it needed 50+% of the votes; this means that if only 10 had voted, they would have needed only 6...
