He can probably try for an exceptional talent visa and come back pretty quickly. He is a Rhodes scholar , legal entry and no unlawful presence.

It is different because the person waives certain things by accepting the SIJ visa. People who come to the US under the VWP waive certain rights for their visa.

A one year punt won't happen, it puts the issue in play for the midterms. The only way the R's would agree to a one year punt is that they get 60% of the Goodlatte bill.

The ruling will delay, but not for three years. It will get struck down or Sessions will go around it eventually. If they were cancelling peoples DACA before expiration, it would be struck down.

That part is legal. People who come to the US under the VWP already sign the waiver, and they can be removed without a hearing.

The CBO score is how much CHANGE to the budget from a law. The taxes people are paying with DACA does not count, as it is the starting point. If there was a law rescinding DACA then the CBO score...

- overstaying a visa becomes a misdemeanor.
- bar all visa overstays from immigration benefits for an unspecified period of time with no opportunity to get a waiver.

Because they feel DACA and TPS are about the same thing. People who have made their lives here and may/will lose protection from deportation. Besides, immigration bills do not come along very often,...

That is the day he is supposed to get on a flight out of the country. He was not held in detention.
