Under Senate rules, if a vote to invoke cloture fails (they didn't get 60 votes) they can vote on it again, and again, and again... until it is invoked.
So, it may be your opinion that it would not be voted on again if it fails (which I hope it won't), but that is not "how congress works" (the Senate), if they choose to prolong the lame duck session and re-vote on it, they may.

wrong again. thats not how congress works. once a bill is filibustered, it is never brought up again in the same manner, in such short period of time. thats the whole point of the cloture vote. yes, technically, it can be brought up again, but in real world, it doesnt get brought up. thats how congress works.
