This is pretty significant because unless the cases are re-filed with the courts - at the expense of thousands of dollars to both immigrants and taxpayers- the administration has shot itself in the foot by arguing against "rootedness" as the basis for not pursuing deportation.
Good reason to be angry. Not so good on the reasoning part. His DOJ always argues what it argues, and the President can reverse it at any time, just as the AG can reverse the BIA, no matter how much the DOJ says what it says. Obama can issue it. He just hasn't done it yet for political reasons. And we have yet to see how those will fully unfold in the months to come.
