The president has the power to do it and it would be difficult to veto his decision. I think the real question here is if he'll do it after November. You argue that he has repeatedly said that he wouldn't sign an EO and prefers the legislative route......


...........OF COURSE he's going to say that......this wouldn't be your typical EO, it's probably the most controversial EO of our time. This EO could potentially benefit more than 1 million people so he's not going to publicly admit that he's willing to do it. WHY? The political implications and public backlash would pretty much cost him the election.

So yes, he can do it. Will he? Maybe not.
Will it be before November? Hell No.
Can an EO of this magnitude be vetoed given the composition of congress and the nature of the EO? Highly unlikely
