This is a quick explanation to why you don't need to send passport pictures with your DACA application (i-821d, i-765, i-765ws)

Lets first start with the fee everyone has to pay which is: $465
$380 ---- i-765 fee
$85 ---- Biometrics services fee

Now remember not every immigrant applying for a work permit has to pay a biometrics fee only, us applying under DACA c(33) have to pay for such fee.... that is why on the i-765 instructions (for everyone else) it says to send 2 pictures.

The biometrics service fee is exactly what it sounds like a service provided by the USCIS to check your background for criminal records etc, in this appointment they will take your fingerprints and picture, Everyone is gonna get an appointment no matter what, because:
1.- You have already paid for this service, which USCIS MUST provide, They are not just gonna take your money and not provide a service.
2.- One of the guidelines for Deferred action is to have a clean record and the only way to truly prove you have no serious criminal record is by a biometrics background check.


Only legal way USCIS can give us a work permit is for us to have been first approved Deffered action, which is what we write in our i-765 application question 16 (c(33)) and in order to have been approved deffered action we just first meet all guidelines and in order to meet all these guidelines we must first go to the Biometrics appointment, if you are given approval of deffered action then they will send your application along with your pictures for work authorization.

So, if you think you are saving time and getting ahead by sending 2 pictures, you aren't since they can not approve both forms (1-821d, i-765) simultaneously they have to go step by step, one must be approved first before the other

Listen to your lawyers if you are paying for one they have this title for a reason, if they told you not to send 2 pictures they knew exactly why.
