I don't understand what your point is. People who cheat and don't pay taxes are always getting an unfair advantage over people who report their income and pay taxes.
You keep using the word "confiscation." It doesn't make any sense in this context. There is not a one-to-one relationship between the amount of Social Security contributions you make and the amount of benefits you receive. It's not like they're just holding your money and then giving it all back to you when you retire. Lots of people receive less than what they pay in. There is a progressive benefit formula and other adjustments. No one -- documented or undocumented -- has some kind of right to get back every dollar of the payroll taxes they paid. The bottom line is that the government never promised to give you back what you paid in -- especially if you were not eligible for benefits in the first place because you are undocumented.
