I think it will be 3-2 no matter which way it goes with the Reagan guy being the swing. By the line of questioning, the Bush appointee seems against this and the Obama appointee for it. I saw a very good immigration lawyer *cough* *cough* mention that they can still appeal to the entire 5th circuit as well.
