I won't hypothesize what they are doing.....but Justice Roberts is inaccurate afaik.
Lawfully present is legally present. It is legal presence that does not confer lawful presence. Visas, Immigrant visas and Citizenship confer lawful presence because that is what the status confers.
In fact, this is why when you fall out of status you
cannot change status within the country. A person lawfully present can change status, but those with DACA who are legally present cannot. It just shows how complicated the issue really is when even our highest court doesn't know the laws.
