I had sent my application back in 6/7 and I made the request on 8/23 (77 days after receipt). On 8/26, USCIS finally scheduled my bio appointment. But then again, I haven't gotten an actual response to my actual E-Request besides the appointment being scheduled. Also, there's the chance that USCIS started to finally start working on scheduling people that were behind, so that could be it.
I'm glad there's a lawsuit against USCIS since it's mostly, if not totally funded by our application fees, so we have full rights to demand them do their job at a reasonable pace.

I think what they mean is that the request system doesn't always work. I remember calling a couple of times and having the t1 tell me she couldn't submit a request because the system was down and to call back later. Also, there were some times when I couldn't submit a request because according to the website I was still within processing time (even though my application had been pending for way over 105 days)
