I mean the right thing to do is taking a leave as someone as posted, however the way I see it (and this is just me), they're in deeper water for not catching on and potentially violating federal compliance, than me, the clueless employee. I played it this way since I received my EAD 3 days after expiration, so I figured the worst they would do is some retro dated rehire to cover themselves.
