Absolutely laughable. If she had won, there would be no uncertainty. DACA would NOT be in danger of getting rescinded through executive action.
In addition, she would have nominated someone to the SC that would break the 4-4 tie on DAPA/eDACA so even if governors wanted to challenge, DACA would probably stay afloat.
