Because in order for other courts to take the case, the Trump (i.e. Sessions) administration would have to fight for it in the courts.
Do you REALLY think Sessions is gonna order the Justice Department to fight for DACA? The most anti-immigration inbred fuck in the entire senate for the last two decades or so? The one who filibustered the DA in 2010 almost single-handily killing it? I do not see it happening.
Our best shot is that someone talks some sense into these AGs and advise them not to pick a fight with their own party.
