I think you guys are interpreting this wrong. The bill is proposing giving the states the power of determining who gets classified as a resident for tuition purposes to see who pays in-state tuition in their state universities, not that each state would determine whether or not we can get an EAD or a green card.
Looking only at the title of the bill, here's how you break it down:
To amend the Illegal Immigration Reform and Immigrant Responsibility Act of 1996- to permit States to determine State residency for higher education purposes
- and
- to authorize the cancellation of removal and adjustment of status of certain aliens who are United States residents and who entered the United States as children
- and for other purposes.
There are states that already grant in-state tuition to non-residents, but it's through loopholes that pretty much give you a "scholarship" that cover the out-of-state tuition part for Dreamers. You remain a non-resident for tuition purposes, however.
The part we care about, of course, is the
cancellation of removal, as that is exactly what would allows us to adjust our status and get PR. And that's determined at the federal level. This bill is not proposing changes to that process.
