This is what each DACA-related bill in the Senate says about felonies and misdemeanors:
S.128 - BRIDGE Act:
(7) has not been convicted of—
(A) a felony;
(B) a significant misdemeanor; or
(C) three or more misdemeanors not occurring on the same date and not arising out of the same act,
omission, or scheme of misconduct; and...
S.127 - SAFE Act
Same as for the BRIDGE Act. No significant misdemeanor. Three or more misdemeanors.
S.1615 - Dream Act of 2017
(iii) has not been convicted of—
(I) any offense under Federal or State law, other than a State offense for which an essential element is the alien’s immigration status, that is punishable by a maximum term of imprisonment of more than 1 year; or
(II) 3 or more offenses under Federal or State law, other than State offenses for which an essential element is the alien’s immigration status, for which the alien was convicted on different dates for each of the 3 offenses and imprisoned for an aggregate of 90 days or more; and...
Since all of these bills allow for three misdemeanors, I am not sure which bill Collins is referring to as the one she supports for having a limit of one misdemeanor. Maybe she is talking about the Senate version of RACA that hasn't been introduced yet. But the House version doesn't provide a numerical limit. It just says that the sum of the sentences can't exceed more than one year. So which bill does Collins support?
