I don't know why this is even a big deal, it was a misdemeanor conviction.

If he had gone to jail, he would have came out a martyr for the right. The conviction carried a maximum of 6 months so I don't think he would have gone to prison, he would have done a couple of months in county jail, and then hit the speech circuit.
