I just married my partner and his business does pretty well and he owns several income properties.

I guess questions is, is this waiver based on financial hardship or just anyone?

There are basically three prongs to hardship:
1. Financial
2. Emotional
3. Medical
You can argue emotional separation (bonus points for kids), and medical if he suffers from any conditions, even if it's a civilization illness like high blood pressure, asthma, or depression. If you can argue something as hardship then go ahead and do so. You can always present a shopping list of reasons and maybe something will be compelling enough to grant the waiver.
