Uber hires you as an "independent contractor", so technically you're more of an entity performing a service rather than an employee. You don't file I-9 in this case. You only sign a W-9 and get paid on a 1099. This is pretty much the same process as starting your own company and freelancing or getting hired as a contractor.

Is it illegal? Probably. Will you get rejected before you don't have an EAD? No.
I wrote exactly the same thing below. You don't have to rephrase what i said. At the end i was correct. Uber doesn't ask you to fill out I-9 because they don't care and not liable for you. But you are liable for yourself. So if you wanna take a risk go ahead.
