True but I don't think he cares. He's hoping that he does get sued and two things happen 1) Federal courts allow whatever he's wanting to do until it reaches SCOTUS at which point he plays his cards and they give him a sign off 2) He expands DACA. Hopes that another state sues him for it. It makes it to SCOTUS (maybe when he's out of office, again doesn't matter to him) and they strike it down in a way that its interpreted that DACA like programs are unlawful.
