Wrong. You dont trigger a bar by border apprehensions (if you’re Mexican and get VR), you have to actually accumulate unlawful presence to have those. Its very likely that because she got DACA she technically has no unlawful presence so there's no need for a waiver, in this case what I wouldve advice was to request AP to attend the visa interview, thus should things go wrong she would come back using her AP.

It's not unheard of that CDJ officer's misinterpret law, but right now CDJ is a MESS, what used to be a one day interview process is now a 2 day interview process, we have clients waiting for an interview since Oct 2019.
