Yes, the legality of the program was argued today but whether USCIS can continue accepting initial applications or not should be the issue here. If a negative ruling by the 5th circuit could jeopardize the entire DACA program, why did the Biden administration risk everything just to gain back the authority to accept new applications?
A better strategy would be to issue a brand new EO with more thorough legal and administrative procedures.

I believe the Texas court stayed the ruling for renewals "while the case is being appealed". Technically, the judge could reverse the stay any time.
