My guess is that at the present it's literally a piece of plastic with Trump's ugly mug on, a preorder for something that won't ever come out.
The only real basis for its existence is EB-5 with lesser basis in EB-1 by having the company you bought into sponsor you as an executive (which is a major stretch if you won't be sitting in any boardrooms).
In this case, EWI and prior unlawful presence would still be a factor. Maybe you could make some weird argument around a grant of nonimmigrant status of some sort while in US followed by 245(k) but that's about it. In her case maybe she could do an EB-5 and I-601A through her husband?
Oh and why doesn't her husband just file an I-130? Because he's barred from it under the Adam Walsh Act.
