II. Detection, Apprehension, and Removal of Unlawfully Present Persons in the United States
In addition to increasing border enforcement, this proposal will substantially enhance our capabilities to detect, apprehend, and remove persons who entered the United States unlawfully and persons who entered lawfully on temporary visas but failed to leave the country when designated. We will complete implementation of an entry-exit system that permits us to know whether foreign nationals have overstayed their visas and will permit us to apprehend and expeditiously remove these individuals. This proposal will equip all ports of entry with the United States-Visitor and Immigrant Status Indicator Technology (“US-VISIT”) system and will deploy this system in an interoperable fashion with all immigration screening systems operated by the Department of Homeland Security.

DHS will "identify, investigate, and initiate removal proceedings" against folks who came here legally but didn't leave.

So anybody who overstayed their visas will be deported?

The way things are right now, they really don't have a way of knowing when someone has overstayed their visa, and well, they don't do anything once someone overstays their visa. They just want to be able to know who is and isn't here, and to be able to remove people who overstay their visas. Sounds ok to me

This isn't something to worry about, they wouldn't be coming after you. (well, as long as you apply)

What? I don't understand. Is this proposal a part of CIR that was proposed recently? I'm assuming yes because the section V of the proposal (pdf file) explains how illegals can become LPR in 8 years. So does that mean that people who came here legally but overstayed their visa won't qualify for LPR if CIR passes?

That's for anyone who came here some time after the bill passes. DreamAct would have higher precedence anyway so I would say don't worry and gather all the evidence you have and arrange it in chronological order for when the time comes.

From this article, the Democrat's proposal for Immigration Reform includes

"8. The bill would create "a broad-based registration program that requires all illegal immigrants living in the U.S. to come forward to register, be screened, and, if eligible, complete other requirements to earn legal status, including paying taxes.""

Don't these two kind of say the opposite things? One says they will deport those who overstayed, and the other says there will be a way to become legal?

I don't understand..are they saying they will only legalize people who CAME ILLEGALLY but WILL DEPORT WHO OVERSTAYED?

CIR would try to fix the problems that the US has with immigration (it's not called immigration reform for nothing :P ). They would let us apply while making it harder for people to immigrate illegally. This is only in case people overstay their visas in the future, or possibly are on an expired visa but haven't applied. This wouldn't be until some time after the bill passes and we are able to apply, anyhow

this only applies to those who came in here and overstayed their visas after the bill passed... got it?? its like pressing the "RESTART BUTTON"

for the "NEW" people who will come here with limited visas,they will double check them... and make sure they dont stay... preventing future illegal immigrants.....

i dnt know if that made any sense at all.... but atleast i tried...

That's how I understand it too.
They'll give path to citizenship to current aliens who qualify....regardless of if they had a visa or EWI....and then come up with a better technology for the future to track down immigrants that overstayed their visa or entered illegally and then deport them. That's sometime after the bill passes.
