Going back to my home country...

I came here legally on a visa waiver program from a European country.

I over stayed my visa.

If I leave, they are obviously going to notice that I overstayed (if they look for the visa stamp in my passport).

Do you think they would let me leave or are they going to detain me? I would have the airline ticket. I would just want to get out of this country.

As long as you have the passport for your country, they are not going to do anything with it. Anyway, good luck with you, and keep us updated on how well you do in your new country.

They'd most likely let you leave. I doubt they'll even look at your passport or your I-94.

The only thing that I'm worried about is the person who takes the I-94 card out of my passport. And if he/she would call immigration. I have a new passport nowadays and the entry card that was in my old passport was torn apart. I still have that card though.. it's just not attached to the old passport anymore. It clearly shows my overstay.

I don't have any experience in this, but from what I've been able to ascertain by reading other people's posts online, you are supposed to turn in your I-94 card to the airline representative when you leave. However, you are not required to do so. The reason to return the card is so that there is a record of when you left the country, but since you overstayed it doesn't really matter that they record when you left the country. Many people ask whether they could be detained when leaving, but the common belief is that they wouldn't bother to do anything since you are already leaving and your overstay will already be on record.

They won't really check. When I left, I turned in my expired I-94 and didn't have any problems.

Of course, you don't have to turn in your I-94. They'll have another record of your departure in the form of passenger manifests.

I left and no one ever asked for the i-94, but i also took it out of my passport, maybe if they had seen it they would have taken it..But honestly they dont care if you r leaving. Just keep any documents you may have to prove that you left.

You dont need anything, I recently left on my new passport and they just checked that the name is the same as on my ticket.

They cant touch you..They have no right to detain you, if they tried you should make a big stink with your countries consulate/embassy...When i was leaving i was waived to an "expedited" line which seemed it was for pilots/stewardess..No problems
