Explanation to why you dont need to send passport pictures with your Application.

This is a quick explanation to why you don't need to send passport pictures with your DACA application (i-821d, i-765, i-765ws)

Lets first start with the fee everyone has to pay which is: $465
$380 ---- i-765 fee
$85 ---- Biometrics services fee

Now remember not every immigrant applying for a work permit has to pay a biometrics fee only, us applying under DACA c(33) have to pay for such fee.... that is why on the i-765 instructions (for everyone else) it says to send 2 pictures.

The biometrics service fee is exactly what it sounds like a service provided by the USCIS to check your background for criminal records etc, in this appointment they will take your fingerprints and picture, Everyone is gonna get an appointment no matter what, because:
1.- You have already paid for this service, which USCIS MUST provide, They are not just gonna take your money and not provide a service.
2.- One of the guidelines for Deferred action is to have a clean record and the only way to truly prove you have no serious criminal record is by a biometrics background check.


Only legal way USCIS can give us a work permit is for us to have been first approved Deffered action, which is what we write in our i-765 application question 16 (c(33)) and in order to have been approved deffered action we just first meet all guidelines and in order to meet all these guidelines we must first go to the Biometrics appointment, if you are given approval of deffered action then they will send your application along with your pictures for work authorization.

So, if you think you are saving time and getting ahead by sending 2 pictures, you aren't since they can not approve both forms (1-821d, i-765) simultaneously they have to go step by step, one must be approved first before the other

Listen to your lawyers if you are paying for one they have this title for a reason, if they told you not to send 2 pictures they knew exactly why.

My lawyer asked for 2 passport pictures to send in. I believe the pictures are for the Employment Authorization I also believe they are the pictures used on the EA card.

This is a misconception, because while the the passport pictures are not required for DACA application, IT IS REQUIRED for the EAD application, and that is why everyone is getting it done. The past argument that we don't need to submit further proof of identification because we're submitting it the same documents for DACA is a completely different requirement than the photo ID they ask for on the EAD application. It is also independent of the biometrics requirement, because it's true, they will take your picture themselves for that, and for the actual EAD card when you get approved, but you still need to provide photos for application purpose (the word MUST is in bold letters in the instruction). The reason why they ask a photo of you in the application is because they want to see a recent picture of you (within 30 days exactly as it says in the form) before they go on to call you for your biometrics.

Sure, if it makes you feel better i say go ahead, but this thread was meant to those who have not send their pictures, you will be fine.

they are, but they can't approve your employment authorization w/o first giving you Deffered action and they can't give you that before you personally go down to your biometrics appointment in which they will take your Pictures for sure.

Again....YES, they will take your pictures there. And YES, they will either take, or use another picture for your EAD card if you get approved. But you have to submit a recent photo of yourself for the application purposes just like the instruction says.

The pictures that really carry weight are the ones from your passport since they have been issued by a foreign government, honestly the only picture that really matters are the ones they will take in your biometrics appointment as they will be DIRECTLY link with your fingerprints.

You are reading the outdated instructions that are meant for everyone else not us, of course they have to send a picture ahead of time because they don't go to a biometrics appointment

It is true, but some people cannot renew/apply for current passport, and that's why it's essential for them to get the recent photos done. Why they required everybody to get it done, I'm not sure. But hey....i'm totally not trying to start an argument here.....if you don't think it's necessary for you, then by all means, it's completely up to you to skip it.

I'm sure all the lawyers telling their clients not to send 2 pictures are wrong. /shrug
