The timing of the appeals court's decision had become of increasing concern to the Obama Administration and immigrant rights' groups in recent weeks. Obama's latest round of executive actions have been on hold since January and delay in the result of the appeals court's ruling was raising doubt about whether the Supreme Court would resolve the case in time to allow Obama to move forward with the programs before leaving office.

The release of the 5th Circuit decision Monday appears to allow the Supreme Court enough time to take up the dispute this term, if the justices choose to wade into the issue. A favorable Supreme Court ruling would permit the administration to implement the executive actions next summer.

Marielena Hincapie, executive director of the National Immigration Law Center, reacted swiftly to the ruling.

"Immigrant families & their US citizen children have been waiting anxiously for the 5th Circuit to rule. Now, we call on the DOJ to seek cert before the Supreme Court immediately where we are more likely to obtain justice for our communities."

This is actually good news. No surprise on this decision. I also read somewhere that if there is a decision before end of November then there would be enough time for Supreme Court to make decision.

So it looks like we should expect a favorable decision sometime next summer?

This sucks!!! Also, the other thing that worries me, is the fact that if DAPA/extended DACA is deemed unconstitutional, then by definition so would existing DACA. :/

I hate to say it but if it does it would help those with DACA, the program is already "too big to fail" they won't simply just revoke them, theyd would stop accepting cases. But then again they can, all theyd have to do is just stop accept renewals and thats it

Man I tell You! didn't we all call it tho? Those SOBs knew They were going to reject yet they waited till the last minute to make the decision. Dragging this out because this is their only legit way of stopping it.

I am gonna go out on a limb here but as sad as this moment is I just have a strong feeling inside that the supreme court will rule in our favor If the administration can expedite things along. The mere fact that the the 5th district decision was strategically put on hold for so long tells you they NEVER had any confidence of winning this so they have to to fight unfairly. If Obama over reached like they said why not rule earlier and let it go to the supreme court to get shot down?

DACA isn't going anywhere, Its political suicide at this point to whoever tries to mess with it. If the GOP win the upcoming election and reverse DACA the party can kiss any chances of winning the White house again for a while. Why do you think Marco is now posturing and pandering about how he feels on immigration reform.

We all know that piece of Sh!t feels the same way about immigrants like the rest of his peers but for the sake of the presidential race has to be careful about what he says because they need hispanic support. Also don't forget that when a Right winger say they are for immigration reform it doesn't mean they are for relief anytime soon. What they really mean is lets secure the border first ---that will never be Secure enough while they keep doing what they do best, drag and stall things out infinitely.
