Quote :1. Judge Hanen in Texas cannot undo the California and New York injunctions (currently in place) that protect DACA recipients from President Trump’s unlawful actions. Both court orders require U.S. Citizenship and Immigration Services (USCIS) to accept DACA renewal applications. Only the circuit courts of appeal corresponding to those states and the U.S. Supreme Court have the authority to undo either injunction. No case related to DACA is expected to go before the Supreme Court until after this summer. The Texas lawsuit does not change that situation.

The hearing for the Texas DACA Lawsuit is scheduled for Aug 8th, We all know that Judge Hanen will not rule in our favor. My concern is that " if this judge rules to stop DACA program immediately, what is going to happen to the pending renewal applications at the time when the ruling is issued? Will they be rejected ?

According to National Immigration Law center website (see above), it says that "Judge Hanen cannot undo the CA and NY injunction that ordered USCIS to accept DACA renewals." Is this correct ? I am so confused.

Please share your thought ! Thanks!

No one can give you an 100% accurate answer because we do not know. Dont forget that Hanen will need a valid reason to declare daca unconstitutional or illegal and that reason will have to hold up in appeals.

Since daca is an executive order cant they just argue that trump has the ability to end it?

I think the texas law suit is trying to say that daca is unconstitutional while the other say that trump went about ending it the wrong way
