Dreamers,

If someone is getting divorced and the defendant, which is the person being summoned has a warrant on his name, what will happen if he goes to court to get divorced?

Will the judge check his warrant status? What if he is illegal as well? Will ICE pick him up?

I don't think divorce will have anything to do with immigration status. I don't think the focus with be about your status. I know someone who did a divorce. They didn't ask about his status. He went to a divorce lawyer and ask about if they have any assets yada yada. Then, that's it. The lawyer prepped everything and after 3 or 5 months they are divorced. He didn't go to a court.

Hey Aleia, the status is just something extra. I was referring more of going to the court to finalize the divorce while having the warrant.

I know someone who is getting divorced and don't know what will happen because the spouse has a warrant and is afraid of going to court.

Ah ok. Well hmmm there is a chance they might look into his profile and if they find out they might contact ICE. Is this person undocumented or in DACA??
