Dreamer tells lawmakers: Obama's DACA program is 'unconstitutional'

A beneficiary of Deferred Action for Childhood Arrivals told House lawmakers Wednesday that President Trump has the right to end the program, calling it "unconstitutional."

Hilario Yanez was brought to the United States by his parents from Mexico at the age of 1. He has since been authorized to stay and work in the United States through DACA, which President Barack Obama instituted over the objections of Republicans and without any congressional authorization.

But Yanez said while he supports DACA's goal of letting younger immigrants who were brought here illegally as children stay in the United States, he doesn't think it's legal.

"I believe what former President Obama did was the right thing to do but the wrong way to do it, which is why I believe DACA is unconstitutional and why President Trump has every right to get rid of it," Yanez said in his opening remarks. "The best way then and today is action by Congress."

Yanez was a witness invited by the minority, a House Judiciary Republican communications official confirmed to the Washington Examiner.

Republicans have long sought to wind down Obama's program and pass legislation approving some variation of it. President Trump pushed Democrats in recent months to make a deal to create a DACA-like program in exchange for funding the border wall Trump wants.

House Democrats, however, have rejected those efforts and promoted ways of helping the "Dreamers" without caving to Trump's wall demand.

"Let's stand behind a permanent solution to DACA and border security reform and fix it once and for all," Yanez concluded in his testimony.

then he should stop using his EAD and Deferred Status, the hypocrisy, mayne....

lastly, nobody can say if DACA is Constitutional or Unconstitutional, thats the Supreme Court's Job, and guess what? it hasnt reached SCOTUS yet for a verdict.

lol you guys don't see past this guy's game. The guy is clearly making the choice of trying to appeal to republicans. Give him a little credit. We need to have both parties in our pockets.

The guy has the shiftiest argument for it being unconstitutional. Essentially, “I think congress should’ve addressed it, and because congress didn’t, it’s unconstitutional.” What I don’t understand is why does someone without any expertise on the subject have the ability to voice, essentially their uninformed opinion, on an important matter? Can’t they actually find a law scholar or a constitutional lawyer? FOH.
