I-601A and I-140 processed concurrently?

Can the I-601A and I-140 be processed concurrently? can they be filed at the same time.

After 9 months my PERM (employment based) finally got approved (this after the immigration firm took about 1 year to put it together and then it got audited. Now, they will file the I-140 and then they will do the 601A. They refuse to start anything related to the 601A unless the I-140 gets approved. They had not mentioned anything about the waiver until I asked. Is there anything I should be doing to get this ready or I should be asking them to do. I an unmarried daughter (over 21) of a green card holder (my mother).

In order to file I-601A the petition must be approved and the priority date has to be current.

So no, they can't be concurrently filed.

Ok thanks, one lawyer about 2 years ago told me they could, but she must have been confused. For Guatemala, I believe the priority date for EB-2 for Guatemala is current. per this bulletin

Hey at least your I-130 got approved. My mom has been waiting for hers to get approved for 11 months now.

Are you sure it was i130 they filed? That's for an alien relative like spouse, sibling, etc. The i140 is for the alien worker (employment).
You need proof of petition approval to file the waiver. Cannot be done concurrently.

Sorry, they filed the PERM. That is what just got approved. thanks for poiting it out.
