My employer paid a recruiter to bring me on, I don't think they wan to let me go just yet. I just think, they know I'm in process and there is no reason for me to lie about any delays. I think it's more of , "Hey, he was verified two years ago, he has a pending app, and he told us ahead of time of the issue" sort of deal.

If I AOS, I will do it via USC wife, and on top of that im 245i, so i got options. I am a believer that our status still remains after expiration for those pending applications.

That is why I asked those that expired to check via eVerify Self Check if you checked out. Worth a try, I haven't seen anyone post any results.

Whats your profession? I also got hired through a recruiter.

I tend to agree here. DACA does not negate any prior unlawful presence so it is not like once you've received deferred action you have somehow "erased your record," so to speak. Deferred action is an enforcement priority for a temporary period of time. I believe that typical AOS considerations will still exist regardless of DACA.

Plus, it is not like we want to work illegally. But when USCIS and their systems mess up our renewal process and their only response is to "wait it out" we have no choice.

I've been following this thread for quite a bit, even after my renewal came, and i would like to suggest a few things. I got my 3rd EAD this last weekend and I just submitted my 3rd AP request 2 weeks ago. All of my applications got approved on-time and without any delays (probably lucky but it's 5 out of 6 so far, pending one):

- It is my belief that calling or emailing USCIS when your case is not under extreme delay will not help your case at all. There's no directive by USCIS for DACA applications to be prioritized with the known issues by their new cloud system. People have tried calling their congressman, lawyer, other means of help without much success. If the electronic issues were not happening in Nebraska, i would encourage for you to follow-up on your case but i think that due to the issues right now, 105-150 total days for your application to be approved will be happening for a while.

- By all means, continue to follow-up with USCIS and escalate your problem if you haven't received a BIO letter in 50 days. This is an extreme situation and will prevent your case from even being reviewed. If you have done your bio, your EAD has not expired, and your application is less than 4 months old, i think you have to take your lucky card for now and wait for your approval. Not trying to be mean, but there are people on this forum that know what's going with USCIS right now and will probably advise the same. Applications over 6 months old should be an extreme case and needs to be reviewed by someone in USCIS.

- Create an account at https://my.uscis.gov/account/link If you don't have an access code, call up USCIS and talk to the Help Desk to give you one. This is the best way to keep updated on your case and for most, it will show your bio date complete and all your applications combined

- If you haven't sent your application yet, PLEASE BE AS CLEAR AS POSSIBLE WITH ALL YOUR PAPERWORK. I think this is very important. I put the check and my photos on the top of the application, followed by the G-1145 form, the TYPED forms, than evidences in the back. I never created any cover letters or anything fancy because that all gets thrown out anyway. I might be crazy but i tend to think when a case officer look at papework ALL DAY, a nice application package will be gold in their eyes and might incline them to work on that one first (:

I'm sorry, but that's all fine and dandy for you to say when you've never had to deal with your entire life falling apart due to USCIS' delays. Many of us have lost our jobs, health insurance, drivers license, and more (I'm losing the home I was in the process of buying). This is my second time renewing and the first time I've ever had to deal with a delay, which is through no fault of my own. USCIS simply dropped the ball this time around and now we have to suffer the consequences of their actions.

They have given us no reason to "have faith" that things will work out. I hoped mine would work out up until the day it expired and it will soon be a week since my expiration date. So maybe your case got sorted out in time, but a lot of us weren't so lucky

I would say you are generally correct which your assertions.
I do not think its going to 'work itself out'.
Yes, maybe some people should not be calling when they're case has been pending 4, 8, or 12 weeks, but that doesn't mean that by them calling or inquiring is clogging the system. 80% of all service calls could be answered by otherwise looking up information at USCIS.gov, yet people call for all types of applications.

I think at this point you're asking too much of some who have been kicked, punched, and pushed around by this latest renewal process, and you're asking for them to like the paint and punishment.
Do I think it's unfair, we're asking for too much, etc, etc. I don't think so.
A fee is required, and its cashed, its allocated for work to be performed by someone. It's not free. They can as well return your money if they are not going to do anything with it. and maybe resubmit at a later date when the issue is addressed.

It's relative to some. Each knows what this means to them, we can't judge them for their methods to find resolution.
