I see nothing wrong with the trade off. It will help stem illegal immigration. More republicans are now getting on board this position of the amendment and it will most likely have to be condition for CIR to pass.

The 14th Amendment contains much more than birthright citizenship; it also contains the equal protection clause so important to present and future Civil Rights.

Graham should stop pandering to his right wing base and concentrate on realistic policy proposals.

you cant just remove the 14th amendment with a simple act, although i think that graham wants the SCOTUS to just rule whenever the 14th amendment does apply to children of undocumented immigrants or not, (as there has to be a case for the supreme court to rule, they cant just rule on something out of their own accord)

Amending the constitution makes getting past a filibuster look like a cakewalk. I doubt the feasibility of this so-called plan.

I dont think that he will be trying to amend it, I think he is trying to enact a law that will get challenged so supreme court would rule whenever 14th amendment does apply to the children of undocumented immigrants. (as supreme court never ruled on this issue)

There is no other interpretation of 14th amendment possible. It spells out that every single person born in the US are citizens, whether they are the children of old slaves(Black Slaves), or new slaves(Illegal Immigrants providing cheap labor).

The only way to deny citizenship to US born children of illegal immigrants is to amend constitution. Any law denying citizenship won't do because very such law is banned by the 14th amendment.

No, he will have a better chance of actually amending the constitution.

Not to mention this has already been examined by the SCOTUS.

United States v. Wong Kim Ark, 169 U.S. 649 (189

"The Court ruled that children of non-citizen Chinese immigrants possessed national citizenship by being born in United States."

This was later extended, albeit not formally, to include children of illegal immigrants as well.

This aside, Jus Soli is a bit outdated and more and more countries use Jus Sanguinis. There is nothing morally wrong with citizenship being based on one's parents' citizenship, and it probably is more logical to do it this way. The children of foreigners still do get the right to live in the country, and in a lot of places have basically the same rights as citizens, usually excluding the right to vote and of course citizenship-based provisions. When you think about it, it makes perfect sense: either your parents do not want to obtain the new citizenship, thus basically swearing their allegiance to another country, or cannot obtain it, implying that they either did not follow proper regulations or haven't lived in the country long enough to be considered a citizen. The children can eventually apply for the citizenship anyway, after they have spent long enough in that particular country.

This is a better way to think about it: Do you think that a child of someone, who is here on a visitor's visa during their stay happens to give birth, should automatically receive American citizenship?
