Great news but its at ICE agents discretion meaning..if he has a toothache, doesnt like how you look, has a bad day, is not in the mood etc...he/she might still report you

Exactly, there is no directive that says "These are the guidelines, and people who meet them will receive a stay of deportation". Almost all agents will enforce the law because they cannot just look the other way. Once they encounter someone undocumented they are forced to report them to the justice department and "register" them for a notice to appear before the courts. ICE is about enforcement; the rest is up to the Justice dept. If you are at the end of deportation proceedings (and believe me, unless you can apply for adjustment of status, you will be ordered deported)there's an ICE form for a stay of deportation with a cost of $600 odd dollars that you or your attorney can file and in which you must give out all of your biographical information; including a copy of your current passport and birth certificate, along with supporting documentation to your request to stay in the country. This is still subject to their "discretion" and they are under no obligation to answer you.

So in the end, they are stating the rules that have been part of their guidelines for years; the difference is that the general public had not knowledge of them. And apparently neither did incompetent attorneys.

Guys, it's still good news. You can speculate all you want. If you ever find yourself arrested, have some balls and fight the deportation proceedings.
