We need to do what we can to stop her deportation, we are trying to reach senators to fight for her right now, if you know someone in politics that might be willing to help, please call them, anything we can get right now improves our chances of preventing Yanelli's deportation to a country where she does not have any kind of support, away from any family that she knows.

She has attempted to commit suicide on two occasions while in custody, she does not need to be deported, she needs to be with her family in Ohio.

Quote:
Hi XXXX

A lot of different things have been going around, we thought for about an hour Yanelli had been deported, however she is still here. Her request for a Stay of Removal was denied a few hours ago and her deportation is imminent. This is a situation of life or death and we need our allies to fall on the side of life.

"Hi I am calling to ask that Senator Reid do everything in his power to stop the deportation of Yanelli. She needs treatment and Senator Reid is the only one who can help. Please help Yanelli.

ICE is saying Yanelli is a criminal, she is not a criminal. They are saying she is guilty of forgery when in reality her Consular I.D. card had the wrong birthdate, a mistake by the Mexican Consulate, not forgery by Yanelli. This is a case where ICE is trying to find an excuse to deny Yanelli's right to stay in this country. Yanelli is hurting and needs treatment, not deportation.

They are saying Yanelli has a DUI, and yes she was convicted of that. She blew a .09 when the State limit was .08. But this doesn't take into account that she was self-medicating. That this is a case that needs to be taken in context. Yanelli was suffering and is still suffering. Yanelli has needed help for a long time. Yanelli's life is in danger.

Regardless of Yanelli's past we need to stop letting Yanelli down and help her for a change. Please join us in demanding life over deportation. Please call each of Senator Reid's offices and make plea for support. We cannot do this without Senator Reid.

Las Vegas office: 702-388-5020

Reno office: 775-686-5750

Carson City office: 775-882-7343

Washington D.C.: 202-224-3542

After you call please reply so we can keep track of how many calls we have made. Thank you.

ICE Confirms DREAMer Yanelli Hernandez Deported to Mexico

Earlier today I wrote about the efforts of DREAMers across the United States to keep Yanelli Hernandez in the country because she’s tried to commit suicide twice. On Tuesday afternoon sources close to the 22-year-old confirmed she was in Mexico to Cincinnati.com.

ICE spokesman Khaalid Walls:

Yanelli HERNANDEZ-Serrano was removed to her native country, Mexico, today in accordance with a final order of removal from an immigration judge. ICE has adopted common sense policies that ensure our immigration laws are enforced in a way that best enhances public safety, border security and the integrity of the immigration system. As part of this approach, ICE has adopted clear priorities that call for the agency’s enforcement resources to be focused on the identification and removal of those that have broken criminal laws, recently crossed our border, repeatedly violated immigration law or are fugitives from immigration court.

In a letter to attorney Jorge Martinez, ICE Detroit field office director Rebecca J. Adducci wrote, “Your request is denied. The basis of this request is that your client cannot depart from the United States due to hardships she will face stamming from longstanding mental illness. You have provided no documentation to support this claim.”

“The removal of individuals with final orders of removal, as well as criminal aliens, is an ICE civil immigration enforcement priority. Ms. Hernandez was never lawfully present in the United States,” Adducci went on to write in the letter.

“An order of removal was entered in Ms. Hernandez’s case by the immigration judge on Jan. 25, 2012, at her request. Thus she is subject to a final order of removal. Further, Ms. Hernandez is a convicted criminal as she has convictions for forgery and driving under the influence.”

Immigrant youth around the country are holding vigils as part of “Undocumented Youth Mental Health Day” in response to Hernandez’s deportation order.

The National Immigrant Youth Alliance, which organized the nationwide vigils, also have plans to launch a 24-hr hotline in the future so that undocumented youth can reach out to fellow young immigrants. The plan is for the newly launched website, undocuhealth.org, to be a resource, and a way to address the very real mental health issues that come along with being young and undocumented.

I feel bad for her, but DUI's are deal breakers. I have heard that even LPRs get occasionally deported.

0.09, that is very low.

The reason IYJL came to exist was precisely around the attempt to deport a dreamer charged with DUI. When no one else was willing to step up for that person and lawyers gave up hope there were a few of friends that came together and fought for his case.

Today, that dreamer, Rigo Padilla, got deferred action and is an active member of the end campaign and IYJL, this was the case he was working on.

So DUI is not necessarily a deal breaker, one has to take into account the whole person, and in this case it was someone in a frail mental state that was using alcohol for self-medication. That person needs to be around loved ones, not separated from her only family to a country that is not her own anymore and which will not be able to support her.

A couple days ago undocuhealth.org was launched listing resources for assistance, publications and research and lots more.

Tomorrow, 9 am until 1 pm IYJL will be doing a workshop at malcolm x college in Chicago. This is for the immigrant integration being hosted by the Illinois coalition for immigrant and refugee rights, there will be several importat politicians present including senator durbin.

The workshop that IYJL and other co-sponsors are planning are directed at mental health professionals. If you can make it, do so. I will post a link that will explain in much greater detail hopefully later today if I remember.
