Hey everyone, I know that Deferred Action for Childhood Arrivals is just a "temporary" solution, so I wanted to start this thread to point out how we can become permanent residents through employer sponsorship, and using Advanced Parole.

A US employer may file permanent residency (green card) for employees:

EB-3 – Professional or Skilled Workers
•
Professionals with a baccalaureate degree;
•
Aliens capable of performing skilled labor (requiring at least 2 years of training or experience) for which qualified workers are not available in the United States;
•
Aliens capable of performing unskilled labor for which qualified workers are not available in the United States.

So if you get a Bachelors degree, you may ask your employer to sponsor you.
If you work 2 years, and your company can prove that they essentially need you for the job, and that no american can do it. They may also file to petition you.

I think it is possible to get Advanced Parole with DACA for this, because it fits in the "work related" category, I know Advanced Parole is a risky move, but even with that, it would be totally worthed to risk it for a Green Card.

So it can actually be a fact that we can benefit even more than we thought with Deferred Action.

Tell me what you guys think about this, and if Y'all think its possible!
(Sorry for the Y'all, I'm from TX.)

I think that by "permanent solution you meant to say "temporary solution", because DACA is not permanent...

I don't think we can get employee sponsorship because we need to have a visa/status to adjust. We have legal status, but no visa.

You guys can correct me if I'm wrong. Not sure what the details are on this.

You dont have to have visa status, they would just petition you, as if they were offering a job to a foreign person.

DACA does not change your status though?

To get employer sponsorship, don't you have to have a F-1 Visa?

I had a similar question a couple weeks ago. From what I understood by searching this forum, we wouldn't be able get sponsors but I may be wrong.
I know a friend of mine is being sponsored by one of the big four accounting firms.
He came to the US with a student visa and right now he lives in California and supposedly will have his status fixed due to the job opportunity.
My question was that since he had a student visa and we may have a work permit, how would it not be possible for us to be sponsored?

Im not saying DACA changes your status, but it helps with Advanced Parole to exit the country for appointments in your own country.

No you need no visa, its like an employer, saying I want to hire this foreigner, so he petitions you. If you get approved you get a green card.

Okay you work for a certain company with your EAD, you ask them to summit employer sponsorship to petition you. You are working for them legally and you are needed because only you can do that job.
They will probably give you an interview appointment in whatever country you are a citizen of. You can go and come back with Advanced Parole.
In the application it never says you have to have a visa status, you dont even have to be living in the us, for an employer to sponsor you.
