Wait only people with overstayed Visa are getting RFE?? I just recently renewed my visa in 20o9. Is that going to be a problem?

No.
Plenty of others who are just EWI got RFE because of time gaps in their continuous presence.

VJB2 is right, EWIs have gotten Rfes. Also, there won't be a problem concerning your visa as long as it was expired by 6/15/12.

You mean your b2?

As long as you overstayed you should be fine. If you have gone beyond the stated period on your i 94 you should be okay assuming continous presence. The only problem might that... how did you renew it? You had to have left the country and hence broken the continous presence requirement..

Yes it think that's it, but i didn't leave the country. They let me do at the immigration place here in Texas. I also used my I-94 to get my driver license. I guess i will just wait.. Thanks!

Quite the opposite. Until recently, most RFEs have been from EWIs.

Overstayers have less of a problem than EWIs since there would be documentation of their departure date and etc.

Okay thanks, but what if my visa hasn't expired? My dad told me that I'm no longer under my "student visa" since i'm not in college. For me to enter college again i have to pay 1,000. So i hope they don't say anything about that. ahh

I have no clue about that one man. Maybe someone familiar with student visas can chime in.

Wait, you still have an active visa/status and submitted your app? You needed to be out of status by 6/15/2012.

Also, being no longer under a student visa because your out of college doesn't sound right... Who else did you speak with this about your situation other than your father? Does your college consider you a drop-out? Did it revoke your student visa?
