What State do you live in? If you are confused about this please have someone look over your application before you send it in.

Hi all,

I have a somewhat more complicated immigration history, where I first came to US when I was 9, moved to Canada when I was 11, and came back right in time for freshman year of high school in 2006.

My question is should I include my Canadian addresses on the form where it asks for all of my places of residences since my initial entry into America?

I've also left to Mexico for one day to renew a visa and went to China for a brief 3 week trip during high school. They are considered brief and absences. Should I provide some an explanation about my day trip to Mexico? It says on one of my visas that I came into the US in 2007 (the year that I went to Mexico), so it might seem like I entered in 2007 vs 2006.

Thank you guys so much!! I really appreciate your help. Sorry if my question seemed kind of confusing... feel free to ask for clarifications.

My guess here is that they only care about American addresses/residences you've lived in.

When in 2007 does it say you entered the US, Did you have legal status during that period?
If it was before June 15, 2007 AND you were under 16 on that date, that still makes it 5 years of continuous residence, so the fact that you originally came in 2006 doesn't even matter. Either way, a brief explanation is enough.

Same with the trip to Mexico/China. IF it was before the 5 years of continuous residence, and/or while you had lawful status, you'll be fine. I believe they only really care about absences if it was when the person was out of status (aka, illegally, expired, etc) and within the 5 years period.

1. Application # i-765

2. Pg # 1

3. Q# 15

4. What is your question?

I am unable to figure out what would be my "current immigration status".

Here are some details:
I stayed in the country after my stay expired. I have a stamped i-94w that has W/T with expiration date 05/21/2001. I have not previously applied for any kind of legal status adjustment. I am not under removal proceedings by ICE.

This is the only thing that is keeping me from sending out the forms. Your help will be greatly appreciated.

So, is W/T the type of visa you had? if so Visa Overstay or you can put No Lawful Status.

on the I-821 part I. Quesiton 15, is has the WT listed as visitor for pleasure.

Yes it says W/T. i've completed i-821 correctly, but i was not sure if I had to put "No Lawful Status" or "Visa Overstay". I came from Argentina and back in 2000 everyone had an open visa to visit the US.

thanks for your help
