Hi there, I was granted an administrative stay of removal early this year (~March) and I currently have a work permit through it. I want to apply for deferred action and I am not sure how to answer one question.

First it asks (3.a) "Are you now or have you ever been in removal proceedings," to which I am certain I should answer "Yes." Then it asks (3.b) for the type of proceedings and allows me to choose from four options:
  • Currently in proceedings
  • Administratively closed
  • Terminated
  • Subject to a final order

I'm unsure as to the meaning of "administratively closed," and I have a feeling that for my situation I should answer with "currently in proceedings." I don't think this is question worth setting up an appointment with a lawyer, so I was hoping someone could maybe refer me to the definitions of these terms. Thanks!

hmmm, I'm not sure. Did you work with a lawyer before when you received your stay of removal? If yes, your old lawyer will probably be willing to answer that without charge. My dad's lawyer answered some simple questions for me when I applied for DACA even though we didn't officially hire him.Of course there's a good chance someone on this website might be able to also answer your question.

I suggest you to call about 5-7 local Immigration Lawyers and ask how much they charge for a consultation (they are about 15-30 minutes).

Many lawyers don't charge anything on the 1st Consultation and this way you get the opportunity to explain your situation and ask for help to answer that specific question.

Let them know that you plan to finish your package by yourself and already have all the required documents and just need help with one question that you don't dare to answer without legal help.

I had my biometrics scheduled on october the 11 and since then i haven't heard anything its been almost 3 months! i was just wondering if anyone has waited this much for their approval? i really don't understand why they would be taking this long when friends and family have gotten their approval in less then 1 month. I guess im just starting to get inpatient lol any information would help thanks

Seen this happen to a few people. I only took my biometrics on Dec 3 so I'll have to just sit tight for a little while and hope I hear something before spring rolls in.

Has anyone who was in removal proceedings applied and been granted deferred action? or do you know someone in that situation? If so, what was your/their timeline? Is it true that it's taking longer for these apps to get approved?
