Some people need to brush up on their U.S. Government knowledge. An EO does not have to "pass". It just requires a simple signature. Plus, I don't think there will be just ONE EO. There will be a series of changes that most likely Obama will implement via a DHS memo just like DACA, not really an executive order. Whatever he does, I am sure he will have his team of lawyers advising him on how to go about doing it.

He still has a lot of power at his disposal. In Texas, Rick Perry a few years ago used his power to require the DPS to start asking for proof of citizenship and that was the moment many people like myself who had a DL and no criminal background, DWI, or anything like that start losing our licenses. It had a lawsuit since the DPS has to vote on those kind of things too, but of course Texas being Texas, they voted it into low the next year.
