Those wavers are already doable with the right attorney, some cash and patience. It's been done, heard of a few cases already. The key is being spouses of US citizens. If they get denied, try again.

After the deportation for non-criminal reasons you still have the I-212 waiver. It gets approved sometimes, saw plenty of success stories on immigrate2us.net.
