Well, the fact of the matter is that this country has treated people without papers as though they have no due-process rights all along when it comes to detention and deportation. Although it's clearly not constitutional, the government has been getting away with it so long that it will probably get away with it again here. As for Obama doing it, I am not sure it should surprise anybody at this point if he smiles and shoves a knife in the belly of some marginalized deportees, while praising others for standing up and speaking truth to power.

What's really troubling about it is that the enumerated rights listed in the Constitution, which extend back through the Declaration of Independence to John Locke, were understood in the eighteenth century as something prior to citizenship--something that everybody had as "natural" rights because they were ours in the state of nature as humanbeings and not citizens of a random country. The government exists, in other words, to protect the natural rights of everybody in the regions it controls, not to decide which groups get those rights and which groups don't.

Give me a break, half of the atrocious 1996 law could be struck down for violating due process (e.g. 10 year bans just being triggered instead of requiring formal proceedings). But that of course would require both courts and DOJ that doesn't have their heads up their asses.
