Texas v. USA News: Recent Filings (Sept. 4, 2015)

"Plaintiffs respectfully request that the Court require Defendants to implement remedial action as to all three-year grants of deferred action and employment authorization issued prior to the Court’s February 16 injunction." - Doc. 304, PLAINTIFFS’ ADVISORY REGARDING REMEDIAL ACTION FOR THREE-YEAR GRANTS ISSUED BEFORE THE FEBRUARY 16 INJUNCTION, Sept. 4, 2015.

"To the extent the Plaintiffs suggest that the Court should exercise any equitable authority it possesses to enter some sort of relief as to the three-year (instead of two-year) terms of deferred action and work authorization that issued before the preliminary injunction—which the Government regrettably, though inadvertently, did not mention during communications with the Court—Plaintiffs have not established the necessary elements to justify any type of additional equitable relief. See Section II, infra. The Government respectfully submits that no further steps are needed to resolve this matter given the Government’s good faith, its sincere expressions of regret, and the care and promptness with which the Government has kept the Court updated and informed, through the filing of Advisories, any time an issue comes to the Government’s attention that may be of concern to the Court." - Doc. 305, DEFENDANT’S MEMORANDUM FOLLOWING THE HEARING OF AUGUST 19, 2015, Sept. 4, 2015.

Texas is asking the court to go back and issue a *new* injunction that reverses any three-year work permit back to the standard two-year period of the original DACA as the original DACA is the only deferred action program available to Dreamers.

The new injunction is based on the halt by Judge Hanen right?

This means we should have a hearing on the DACA Extension soon?

I can't wait for Abbott to be a one term governor.

Same old Bs, Just a mother day, They are dragging this out by focussing on everything else ...except for the main issue itself..Is the injunction justified and should it be lifted or not.

Am I the only one that feels that the towel has been thrown at DAPA/DACA?

Wtf??? Supposedly immigration reform advocacy groups are spending their time ridiculing Trump et al. - whom they elevated to serious Republican contender by treating him seriously, the mainstream media simply followed these 'voices' for the immigrant community, big mistake - and using resources that could instead be used to protect the immigrant community from arbitrary detention or deportation.

It was thrown, but not like we can really do much.
The administration should get a change of venue (like to the administrative court in DC that dropped this lawsuit before), or issue the substantial regulation, or seek to have it dropped due to a recent Supreme Court ruling that struck down a part of the APA, or hell even refuse to enforce outside the court's jurisdiction (we'd lose whatever part of Texas and that's about that).

They have ways of decapitating the lawsuit but they just continue the pissing contest against the republicans.

Mark my words they're waiting until 2016 elections (probably 2-3 months before registration deadlines). That's when the lawsuit will die because they need the Latino vote.

No, I know that, but it amazes me that these orgs believe we buy the stalling from either side.
