Problem being - that waiver is not available to parents (unless they have a LPR/USC spouse or parent of their own).

DAPA would bypass the issue with EWI parents of citizens and their ineligibility for I-601/A waivers. Get DAPA, get AP, travel, return, have your kid petition you once he/she turns 21, you'll have your green card within 6 months.

I think it will prevail. The administration has been too stupid with this lawsuit, much more stupid than one would normally expect. They'll publish the regulations and Hanen will go back to being a two-bit judge in a backwater court in rural Texas. The lawsuit will die on its own since it'll be moot.

All the news are positive about prevailing eventually but the problem is time. The question is when? Eventually, it will go to Supreme Court but do you think it will pass before 2016 Elections? I don't think they are stupid. I just think it is all political football. DACA 2012 was pure political decision as well. If it does prevail right before elections then chances are good for Hillary as well as Dems taking house and senate. That is what we want right?

As I said, before 2016 elections when the entire war machine starts and both sides start flinging shit at each other.

The lawsuit itself is irrelevant. Injunction is due to a violation of APA (they didn't publish regulations into the Federal Register). They will publish regulations and the lawsuit is moot. Retardicans could sue again, but unless they get extremely lucky - the judge would tell them to fuck off as did the court in DC with the original DACA.

Think of it this way. Your parents die. You and your only sibling are fighting over who should get their car (because its a nice car, let's say a Porsche). You go to court, the lawsuit takes a few months. A tsunami comes and the car is on the bottom of the ocean somewhere, dragging it out and fixing it would exceed its worth, and it'd never be at 100% anyways. The lawsuit regarding it is completely moot then since the subject matter has been destroyed. Same situation here.

Which month do you think it will prevail next year? Will it be in Supreme Court?

I too get the feeling that the 5th circuit which will likely deny lifting the injunction is holding off their decision to make sure the Supereme court doesn't get it in time for June 2016 .
Of course!...That was always the plan.

IMO, There is no doubt in my mind that this was one big political strategy for the 2016 presidential election. There is no way Obama's people didn't see this coming, it was all to hush the fight over illegal immigration think about it,give them something to quell the heat. Now fast forward until election time and watch how much gets done to get this implemented . Hillary isn't exactly running away with this election. .

I call shenanigans on the lot of them.

1) Publish regulations, firstly because it is the right thing to do. Not talking goodwill here; talking about regular admin procedure.

2) Stop playing w people's lives and making people suffer just because sociopaths in the admin believe people 'should' struggle. Suffering does not make people better.*

3) It's high time the country moves forward. High time.

*Repost this if you too have been a victim of extreme bullshit.
