I don't think you have to until you get your PR card. Save yourself the trip to the SS office because once you get it, you'll have to go again to get a new SS card that doesn't have the inscription on it saying it's only valid to work with DHS authorization.

Hi guys!

I DACA Recipient.
Married to a US Citizen.
Have left and re-entered the US through Advance Parole.

My question is what are the necessary applications for me to fill-out and apply AOS and obtain US Residency? All information, and links are greatly appreciated.

I entered through the VWP. On form I-485, am I supposed to write anything for nonimmigrant visa or just leave it blank?

TIA

Hey Guys,

Trump is about to screw all of us so I am in the process of starting my AOS by marrying my USC girlfriend of 4 years and have several questions.

Here is my situation:
  • Legally entered the US with a tourist visa at age 14.
  • Overstayed since and have not left the country.
  • Received DACA in 2012 and renewed it in 2014
  • EAD is to expire in December 2017 since my EAD is 3 years. I am assuming the worst that my EAD will be invalid when Trump gets into office.

My problem with the AOS application is that:
  • Will it be suspicious to file the AOS right after we get our marriage certificate from City Hall?
  • As of now, we don't share any bills, bank accounts, addresses, etc. Will it be suspicious to have all of that changed a month before we file the AOS?
  • We have traveled a lot around the US and have a good amount of pictures together.
  • My girlfriend is still in school and has no income but I have been making above the poverty line since I got my EAD and my assets are over 100k. Should I still get a sponsor?
  • What am I supposed to put in the I-864 for her income? $0? Also she has been filing her taxes as a dependent under her parents.

I am planning to see an immigration attorney once we have everything together and have more specific questions.

At this point with Trump elected, I am mentally prepared that I might lose my job and remain unemployed for the next months.

What do you guys suggest?

Thanks in advance

An updated check list would be of great help.

Time is against us, now that Trump is Americas Fearless Leader.
And Help Group "Latinos Progresando" located in Chicago are taking forever to help file AOS.

Especially this
Will it be suspicious to file the petition for alien relative right soon after we get our marriage certificate from City Hall?

We have almost the exact same life, except I am 28 now and been dating my GF for only a year and we've been living together for 6 months.

Just from what I've read, you should be fine with opening a shared bank account only. Maybe move in together and be in the same lease? If not just explain you are in the process to find a place or something. This is something you should discuss with a lawyer.

Also, you for sure will need an sponsor. It doesn't matter how much you make. The sponsor has to be a USC or PR.

Cheers man!

I filed for AOS 4 months after obtaining our marriage certificate. I would have filed the next day but had to apply for AP to clear my EWI. If you can submit right away, do it. That's what the marriage interview and I-130 is for, to prove your bonafide marriage.
