Sadly, I was never even mentioned 212(d)(3).

During the recent slowdowns in processing, my employer offered to sponsor for H1B. I spoke with my current attorney and he said there simply was no way around the 3/10 bar.

Not sure how likely it is to qualify/be-granted this waiver, but it bothers me that lawyers don't know or don't tell you about this option

IMHO it's not worth triggering a ban. I can always work as a contractor under an LLC or drive for Uber to make ends meet (DL should not be an issue in CA), in the meantime I leave the door open for marriage, I'm an overstay.

Obviously, I might have no idea what I'm talking about but I love brainstorming here. Better than twitter - u don't know me.

I am definitely speaking with another attorney to explore 212(d)(3). Staying without permit would mean losing my career.

Those H1B's look promising but the ban is scary. I wonder if there are any figures out there about how many people get slapped with the ban and are denied the visa.

Uber driving is rather dangerous, with all the crazy passengers and crazy drivers on the road alike.
