That alone is not the issue. Being EWI is the bigger issue I think beacuse if you have a path to a green card like with marriage, a lot of times (at least in the old days), they would let it go. I have two family members who were able to do this. If you go in with no shot at all to adjust your case AND you have a final order, even during Obama, I think this guy would have had a bad day - although perhaps not this bad.

Late 40's Dreamer (Holy Fucking shit I'm almost 50 and still dealing with this), aged out of original DACA and didn't have a chance to apply for extended DACA after Republicans killed it on the vine.

Well, if he didn't have that deportation order ICE would have deported it and he would have been allowed to adjust....? I know many people with a EWI who adjusted, they had to leave the country but this guy is going to be banned for 10 years and probably wont be able to adjust even then
