So for those of you who are about to submit your packet, make damn sure that you got your gonorrhea test done! Honestly, that was pretty disappointing -- I think we did all right, but having to delay the entire process for this RFE is another hassle in an otherwise already cumbersome process. I blame the civil surgeon for lacking the competence to keep up with the latest requirements.

Once I even get the paperwork submitted, who knows how much longer until they adjudicate our case?
Can you tell us what your response was to this?

Question.

It seems that the officer asks if you have committed any crimes. Obviously you will respond no. But are they asking you this to see if you will self confess or does the officer have evidence you comitted a crime and wants to see your response?

Adjudication officers ask questions to make sure the benefit sought is in compliance with the rules of INA law. It is not enough to simply fill out a form. The interview is an investigation of both the beneficiary and petitioner and if the adjudication officer may award a benefit. The only way they can do that is to ask questions to see where that compliance fits.

He did not ask us why. He asked whether we had people join for a celebration.

The officer said I can go back to the field office to drop off the updated I-693. Is that accurate? The RFE only tells us to mail the form back, but we live so close to the office. So...

Do exactly as the officer states...It should result in an approval not after. You don't have to mail it because your case is now at the "local office".

What if I say it's for tax purpose and getting a green card? Should we be honest about the green card part?

Ianus, do you have an estimate for how long it takes to adjudicate this kind of case after the updated I-693 is submitted?

The officer told us that this has been a common RFE for applicants lately, because the civil surgeons haven't caught up with the rule...11 months after it was first announced.

It shouldn't take long at all. The officer should be able to make a decision as soon as the evidence is seen. You should receive an update almost immediately after.

On it being common, AOS takes around 4 months to just over a year. It should come as no shock that such a regulation would not be implemented smoothly. The procedure(AOS) takes a bit of time.

In fact, I would anticipate the same issues for the new I-485 form in August. It will likely result in more delays in the fall/winter as USCIS officers have to issue rejections because of the incorrect form.
