If Trump were so determined on DACA being unconstitutional, there would not be a 6 month delay. Come on. Think about it.

Paxton will go forward and will lilely fail. Read on issue/claim preclusion and collateral estoppel.

As for the 6 month deadline, Trump could end up extending it if Congress does not find a solution. So much can happen in 6 months.

Twitter thread by Greg Sargent:

1) A quick thread on this idea that Trump will supposedly end DACA on a "six month delay." A few questions remain unanswered.
2) Does this mean that after six months, all of DACA ends immediately, or that *at that point,* people will start losing DACA as it expires?
3) Does it mean that over the next six months, all of those whose DACA status would have expired get automatic renewals?
4) Does it mean that all expirations that would have happened over next six months are pushed back six months?
5) None of us knows *anything at all* about what this is supposed to mean. Stop getting snookered. FIN

anything can happen from Sept 5th - Mar 5th (6 mos)

Legalization possible.
Lawsuit Thrown out possible
Trump keeping DACA possible in 6 mos

Trump is not a policy guy. When he says 6 month delay it means "I'm leaving the program intact as it is, see me in 6 months, congress get to work. You wanna sue, go ahead"

Reuters- WASHINGTON (Reuters) - President Donald Trump has decided to scrap a program giving work permits to people who came to the United States illegally as children but will give Congress up to six months to find a legislative alternative, two sources familiar with the situation said on Sunday.

The president decided to delay enforcement of his decision to end the Deferred Action for Childhood Arrivals, or DACA, program, so as to give Congress time to devise legislation to replace it, the sources said.

DACA protects nearly 800,000 young men and women, often called “Dreamers” from deportation.
